Support & Custody Modifications
In Arizona you are entitled to modify child support orders when there is a change in income or employment. It is important that you petition the court for these modifications as soon as they become necessary because if you wait to long to modify them, you will either owe substantially more than you would otherwise be required to pay, or be deprived of a substantial amount of support to which you are entitled to recover from the other party.
Generally speaking, you are permitted to revisit Custody arrangements one year after the order for legal decision-making has been entered in court. However, if there is an immediate issue regarding the best interests of the children, then a court is willing to consider modifications to custody at the time it occurs.
The Modification Process
There are number of issues that come into play during any modification proceeding. While a number of people attempt to modify court orders on their own, there are often a number of sophisticated issues that a court must first consider. Therefore, before attempting to modify your current support or custody orders, contact the SPK Law to find out whether any of the legal requirements for modification apply to your case.
